Welcome to The LionsGate Trolley Company, Ltd., doing business as the Great Canadian Trolley Company (together, the “Company”, “we” or “our”). This document sets forth the terms and conditions governing the experience of our customers and website users (herein referred to as a “Passenger” or “you”) when utilizing our:
- website at https://greatcanadiantrolley.com/ (our “Website”), including any email, text and other electronic messages between you and this Website or its representatives;
- systems and apps;
- service offering materials;
- tourism services; and
- other services we may provide to you from time to time.
(collectively referred to as the “Services”)
By utilizing the Services and accessing our platforms, you acknowledge that you have reviewed, comprehended, and consented to abide by the terms outlined in these Terms and Conditions, along with our Privacy Policy and General Disclaimer and Liability Limitation. If you are acting on behalf of other participants, you affirm that you possess the authority to accept these terms on their behalf. Please read these terms carefully before using our Services.
1. Terms of Tickets, Payment and Provision of Services:
Point of Purchase:
Sightseeing tour tickets, or any other tickets related to Services we may now or in the future choose to provide, shall be exclusively purchased through our Website or a Company authorized sales agent. For inquiries about purchasing other services not listed on our Website, please reach out directly to us at: hello@greatcanadiantrolley.com.
Provision of Personal Information:
If you wish to purchase any Services you may be asked to supply certain personal information relevant to your purchase. By providing said information, you affirm that you are of legal age, that you possess the right to use the provided payment methods, and that the information you provide to the Company is true, accurate, current and complete. Your submission of personal information is governed by our Privacy Policy. Please refer to our Privacy Policy for more details.
Forms of Payment:
We accept payment for Services using major credit cards (Mastercard, Visa, American Express, Google Pay, Apple Pay) or any other credit card as we choose to add from time to time. Cash payments are not accepted. Our promotional offers may have specific terms.
Prices and Fees:
- Full payment by credit card is required to make a reservation.
- Prices for Services are quoted per person and in Canadian Dollars, unless otherwise specified.
- Prices for Services at time of payment may include GST, PST, local taxes and any applicable booking fees.
- Not included as part of the price of Services are any applicable attraction admission prices incidental to our Services and tips to our drivers, guides and other employees, unless otherwise stated.
- Certain charges such as fuel surcharge may not be included in the stated price and should be paid directly to our agents when using our Services.
- Prices for the Services are subject to change without notice until a booking has been confirmed.
Rights Reserved:
We reserve the right to change our vehicle types, Services fares, routes and times without notice to you. Please check the current schedule and fares on www.greatcanadiantrolley.com.
Form of Tickets:
Physical tickets will not be issued. All tickets will be received by you in the form of a QR code for scanning on and off the Company vehicles. You may provide your QR code in digital or physical format.
Resale, Transfer and Assignment of Rights:
Reselling or transferring tickets to other individuals, and assignment of any rights under these Terms and Conditions is not permitted.
Minors:
Passengers aged three (3) to twelve (12) years receive reduced child rates. Passengers aged two (2) years and under may travel free of charge provided they do not occupy a seat in a vehicle. Passengers under fifteen (15) must be accompanied by an adult. Proof of age may be requested and required.
Ticket Redemption:
Valid tickets can be redeemed on board our vehicles at any stop, but seating on board vehicles during busy times is not guaranteed, so redemption may be denied in the sole discretion of Company employees.
24 Hour and 48 Hour Ticket Description:
In the case of our hop-on, hop-off tour Products, a twenty-four (24) hour ticket grants you a consecutive full twenty-four (24) hours of hop-on, hop-off touring on any of our vehicles within their operational hours on the designated date(s). Similarly, a forty-eight (48) hour ticket grants you a consecutive full forty-eight (48) hours of hop-on, hop-off touring on any of our vehicles within their operational hours on the designated dates. After hopping off, please refer to the online schedule for the next available vehicle. Please note that traffic and unforeseen circumstances may affect the frequency of our Services.
Passenger Safety:
Your safety is our top priority. Please remain seated while a vehicle is in motion, keep all body parts inside the vehicle, and follow Company staff instructions diligently. Alcohol consumption is strictly prohibited when using our Services, and smoking or vaping is not allowed onboard the trolleys. We reserve the right to ask passengers to disembark in the event of offensive conduct, intoxication or for safety reasons.
Other Accommodation:
Passengers needing assistance must be accompanied by a qualified companion. Service animals are welcome without charge, subject to conditions. Please note that, due to the size of our buses, we are unable to accommodate special needs bookings. We are unable to accommodate luggage on board.
Consent to Use of Likeness:
Your consent for the use of your likeness in photographs, videos or other media in marketing and promotional materials is consented to by your use of the Services. If you wish to remove your consent please reach out directly to us at: hello@greatcanadiantrolley.com.
Passenger Changes and Cancellations:
Changes or cancellations are permissible up to twenty-four (24) hours prior to the scheduled Services. Any changes made within twenty-four hours of the Services will render all bookings non-refundable. No-shows are not eligible for refunds.
Emergency Situations:
In the event of an emergency situation, including but not limited to medical emergencies, accidents, or unforeseen circumstances, Passengers are advised to remain calm and follow the instructions provided by Company staff. Our priority is the safety and well-being of our Passengers. If an emergency arises:
- Staff members will provide guidance and assistance as needed.
- Passengers should refrain from any actions that may exacerbate the situation and cooperate fully with staff instructions.
- Emergency services will be contacted immediately if necessary.
- Depending on the nature of the emergency, passengers may be asked to disembark from the vehicle or remain seated until further instructions are provided.
- Passengers are encouraged to carry emergency contact information and any necessary medical supplies with them at all times.
2. General Disclaimer, Liability Limitation and Indemnification:
Our provision of the Services to you is governed by our General Disclaimer and Liability Limitation. Please refer to our General Disclaimer and Liability Limitation for more details.
3. Intellectual Property:
All content, trademarks, and designs associated with the Company, its Services and the Website are owned by the Company unless otherwise stated and are protected by Canadian copyright and trademark law. Any unauthorized reproduction or use of intellectual property without the prior consent of the Company is strictly prohibited and constitutes a breach of these Terms and Conditions. Linking to the Website is only permitted with prior written consent of the Company. By using the Website you acknowledge that the Company is the sole owner of the Website and all intellectual property rights within.
4. Waiver and Severability:
Our failure to enforce any right or provision of these Terms and Conditions does not constitute a waiver. If any provision is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions of these Terms and Conditions will remain and continue in full force and effect.
5. Termination:
These Terms are effective unless and until terminated by either you or us. You may terminate these Terms at any time by notifying us that you no longer wish to use our Services, or by discontinuing use of the Website.
You are prohibited from utilizing our Website or Services for unlawful purposes and your access to our Website or Services may be suspended or terminated by the Company at its sole discretion.
All provisions of the Terms and Conditions and any other documents applicable to you on this Website which, by their nature, should survive termination will survive termination, including, without limitation, intellectual property provisions, warranty disclaimers, indemnity, and limitations of liability.
6. Changes to Terms and Conditions:
The Company retains the right to periodically change, modify, or remove portions of these Terms and Conditions without prior notice. Your use of the Services and the Website is undertaken at your own risk and constitutes acceptance of these Terms and Conditions.
7. Governing Law:
These Terms and any separate agreements whereby we provide services to you will be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to its conflict of law provisions.
8. Entire Agreement:
Unless otherwise stated in the Terms and Conditions or in written notice to you, these policies apply to all Services sold to you on this Website and by the Company. These Terms and Conditions constitute the entire agreement between you and the Company, govern your use of the Website and Services and supersede and replace any prior agreements we might have had between us regarding the Website and the Services, including but not limited to any prior versions of these Terms and Conditions.
